Law Clerk to the Justices of the Superior Court

The Justices of the Massachusetts Superior Court seek 54 law clerks of outstanding ability to serve one-year terms from September 1, 2009 through August 31, 2010.  There are 47 law clerk positions in Eastern Massachusetts, based in Boston, and seven law clerk positions in Western Massachusetts, based in Springfield.  Among other duties, law clerks prepare memoranda and write draft decisions that may encompass any aspect of court procedure or substantive civil or criminal law within the Superior Court’s jurisdiction.  Law clerks have unmatched opportunities to observe courtroom practice and direct access to the judges to discuss cases and legal issues.

Excellent writing, communication, and accurate research skills are absolutely necessary for the position, as are high professional and ethical standards.  All law clerks must have graduated law school by the start of the clerkship and reside in Massachusetts during the duration of the clerkship.  Bar membership is not a requirement.  Because the Superior Court is a circuit court, both judges and law clerks rotate, on average, every three months to a different county courthouse.  Accordingly, all law clerks must have access to a reliable car and be willing and able to drive to their assigned courthouses.

Pro Bono Opportunity

The Massachusetts Supreme Judicial Court's Board of Bar Overseers is seeking attorneys to represent, pro bono or for a substantially reduced fee, respondents who are being investigated for or charged with violations of the rules of professional conduct by the Office of Bar Counsel. At present, about 15% of respondents appear pro se and 50% are represented by pro bono counsel. The Board will provide a training session and materials. LACCM - Externship

The Legal Assistance Corp. of Central Mass. ("LACCM") is the primary provider of free civil legal services to the poor and elderly of Worcester County. Its main office is at 405 Main Street in Worcester. It has satellite offices in Southbridge, Milford, Fitchburg, and Athol. LACCM attorneys and paralegals specialize in housing and homelessness work; welfare, disability, and employment rights issues; family law matters; immigration issues and problems faced by the elderly.

LACCM administers a program for homeless individuals and families called the Zarrow Project. The LACCM attorney in charge of the Project recruits volunteer lawyers in the private bar to visit homeless shelters and take cases for homeless people and those at risk of becoming homeless. The LACCM attorney handles some cases from local homeless shelters.

The student intern will have the opportunity to assist various LACCM advocates working on one or more of these projects. The student intern may also assist the LACCM Zarrow attorney in visiting homeless shelters, interviewing clients, talking with the private bar about their cases, compiling written reports, and working on individual cases. The intern will also have the opportunity to help the advocates in one or more of LACCM's substantive law units on their cases. This work may include interviewing clients, filing and picking up papers in court, and helping prepare cases for hearing.

LACCM is making a strong effort to outreach to diverse populations. We would especially welcome students who speak languages other than English who are interested in assisting our outreach efforts.

Duties: Chapter 74 of the Acts of 1999, codified at M.G.L.c.6, §178C-178Q, establishes the Sex Offender Registry Board (SORB) and sets forth its responsibilities and authority. The Sex Offender Registry Board is responsible for the registration and timely classification of convicted sex offenders in accordance with the level of risk to reoffend presented by the offender; and to assess the risk of every sex offender in Massachusetts and to disseminate information to the public based on those assessments about sex offenders who pose a risk of reoffense. The General Counsel will oversee compliance with the new law in all respects. He/she will oversee all litigation in which the agency is a party. He/she will provide timely legal advice and representation to the Chairperson, Executive Director, the Board members, staff and the public.

  1. The General Counsel will approve all legal strategy and legal decisions made in all litigation to which the Board is a party.
  2. The General Counsel will verse and assign SOR legal staff in all administrative hearings, G.L. c. 30A, appeals to the superior court and appeals to the Supreme Judicial and Appeals courts.
  3. The General Counsel will represent the Agency in administrative hearings, G.L. c. 30A, appeals to the superior court and before the Supreme Judicial and Appeals courts as deemed appropriate.
  4. The General Counsel will advise the Chairperson and the Board members on legal questions and shall provide timely updates on the status of all litigation and appeals of agency action.
  5. The General Counsel shall resolve crisis issues as they occur, including agency policy conflicts and legal and legislative interpretations.
  6. The General Counsel will provide for and ensure training for the legal staff, outside agencies and the public.
  7. The General Counsel will draft documents as needed and address requests for information and tort claims litigation involving the SORB.
  8. Other duties as assigned.

Qualifications:
MINIMUM ENTRANCE REQUIREMENTS: Applicants must have at least (A) five years of full-time, or equivalent part-time, supervisory or managerial experience in the particular specialty (i.e. scientific, professional, or technical) and (B) of which at least two years must have been in a managerial capacity. The above entrance requirements are to be used only for positions for which educational and/or experience requirements have not been established by the General Laws. Entrance requirements established for particular positions by law must be used. SPECIAL REQUIREMENTS: Applicants must possess current licensure and/or registration requirements established for the performance of the duties of the position.

Preferred Qualifications:
A. The General Counsel must be a member in good standing of the Massachusetts Bar and must have excellent written and oral skills, complete knowledge of civil and criminal procedure, appellate procedure, including knowledge of administrative law and hearing procedures, excellent negotiation and communication skills, excellent research skills and the ability to interpret law and legislation.

B. The General Counsel must have a juris doctorate degree, admission to the Massachusetts Bar, and at least two years of experience in administrative, civil and criminal practice. The General Counsel must maintain good standing to practice law in the Commonwealth and must maintain a valid MA driver's license.

Duties:

  • Review and edit draft Commission decisions;
  • Provide legal advice to commissioners of the CSC. Also provide advice regarding legislative actions in which the commission has an interest;

Legal Assistance Corporation of Central Massachusetts - Senior Supervising Attorney
The Legal Assistance Corporation of Central Massachusetts (LACCM), a non-profit legal services program providing free civil legal assistance to eligible low-income and elderly clients in the Worcester County area, seeks a senior supervising attorney to work in its General Law Unit. The General Law Unit handles a variety of housing-related matters on behalf of low-income tenants, including representation in eviction proceedings, public housing denials, and Section 8 terminations. The unit also has a fair housing "testing" program and litigates housing discrimination cases in administrative forums and in state and federal court. The unit also seeks to expand its work in the area of foreclosure defense. The senior supervising attorney will be responsible for supervising the work of staff attorneys and law student interns in the unit, including coordinating unit meetings, conducting annual evaluations, reviewing unit cases prior to closure, and advising unit staff members with regard to substantive or procedural issues in their cases. The individual will also assist in grant writing/reporting and handle a modest caseload, as appropriate.

QUALIFICATIONS: Admission to Massachusetts Bar. Significant housing law experience, including litigation of eviction cases, is required. Prior experience litigating housing discrimination or other civil rights cases in court or at the MCAD is a plus. Prior experience supervising attorneys or paralegals strongly preferred. Strong interpersonal and organizational skills are a must.

The Lawyers' Committee for Civil Rights Under Law of the Boston Bar Association (Lawyers' Committee) seeks an experienced litigation attorney with a demonstrated commitment to civil rights.

Background: The Lawyers' Committee is a private, non-profit civil rights organization dedicated to fighting race and national origin discrimination through impact litigation, individual case representation, community education, community development, and policy advocacy. Lawyers' Committee staff attorneys and pro bono attorneys from members firms provide legal representation to combat racial and national origin discrimination in a number of areas of law, including fair housing, predatory lending, police misconduct, racial violence, voting rights, education, public accommodations, employment discrimination, and community economic development.

Qualifications: The ideal candidate will possess three or more years of litigation experience, the ability to assume a varied case load, excellent writing skills, strong interpersonal skills, the ability to work independently and as a co-counsel with private law firms, and experience working with diverse communities. Prior experience in civil rights law or impact litigation is preferred, but not required. Must be licensed to practice law in Massachusetts.

The Legal Assistance Corporation of Central Massachusetts - Staff Attorney
The Legal Assistance Corporation of Central Massachusetts (LACCM), a non-profit, legal services program providing free civil legal assistance to eligible low-income and elderly clients in the Worcester county area, seeks a full-time staff attorney to work in its Families and Children Unit. The staff attorney will be involved in legal work that encompasses representation of individuals in domestic relations cases involving domestic violence. The individual will have significant client contact, and will assume an active caseload while continuing to accept new cases.

QUALIFICATIONS: Admission to Mass. Bar, or eligible to sit for next Mass. Bar examination, or entitled to practice under a Mass. practice rule. Fluency in Spanish or Vietnamese helpful. AALDEF - Office Assistant - Volunteer or Work-Study
The Asian American Legal Defense and Education Fund (AALDEF), founded in 1974, is a national organization that protects and promotes the civil rights of Asian Americans. By combining litigation, advocacy, education and organizing, AALDEF works with Asian American communities across the country to secure human rights for all. Current program priorities include economic justice for workers, immigrants' rights, voting rights, language access to services, affirmative action, youth rights and educational equity, and the elimination of anti-Asian violence, police misconduct and human trafficking. Responsibilities include data entry, organizing press clippings, answering phones, doing mailings, and performing general clerical duties.

Other responsibilities include providing support for fundraising events, and community education and outreach projects.

Computer experience with databases, graphics and web programs helpful. Chinese language ability (for press clippings) is also helpful, but not required.

This position is open ONLY to students with work-study grants or students who wish to volunteer. Schedule is flexible, work to be done during office hours 9:30am - 5:30pm. No evenings or weekends.
